When Should I be Paid Overtime?

California law requires employers to pay overtime wages to employees who work more than 8 hours in a day and more than 40 hours during a week.

What Should I be Paid for Overtime?

California Law requires employers to pay employees time-and-a-half of the employee’s regular rate of pay for all hours worked in excess of 8 hours up to and including 12 hours in any workday, and for the first 8 hours worked on the seventh consecutive day of work in a workweek.

California law requires employers to pay employees double the employee’s regular rate of pay for all hours worked in excess of 12 hours in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek.

California law defines the “regular rate of pay” as the compensation an employee normally earns for the work he or she performs. The regular rate of pay includes a number of different kinds of compensation, such as hourly earnings, salary, piecework earnings, and commissions. In no case may the regular rate of pay be less than the applicable minimum wage. Employers routinely miscalculate the regular rate of pay for employees that earn commissions, shift differentials and bonuses.
